Eric J. Davis has been a practicing attorney since 1994 and is the senior criminal defense attorney in our law office.  Mr. Davis graduated from Howard University with honors in 1991 and from Tulane University Law School with honors in 1994.  He was trained by legendary trial attorney Gerry Spence at his Trial Lawyer's College and honed his trial skills by learning from some of the best trial lawyers in the country at the college.  Following graduation, Mr. Davis was asked to join the staff of the Trial Lawyer's College.  He has successfully defended numerous criminal cases in Federal and State Court.  Our office has obtained not guilty verdicts and dismissals in all types of criminal cases and in numerous different counties.  Mr. Davis has tried over 100 cases to verdict.  He has won over 80 percent of the cases he has tried.  He has tried all types of federal and state court criminal cases ranging from Capital Murder, to multiple defendant drug conspiracies, to misdemeanors.  Moreover, Mr. Davis has defended federal criminal cases in every federal district in the State of Texas and in federal district courts in Florida, Louisiana, and Illinois.  Our office has experience handling high profile cases and understands how to effectively protect clients when prosecutors attempt to use the media to poison public opinion against our clients.

While serving as a prosecutor, Mr. Davis was selected (based on trial skill) to serve in a sex crimes unit where lawyers focused on prosecuting all types of sexual assault cases.  This experience and training helped Mr. Davis develop experience in defending sexual assault cases.  Our office has successfully represented people accused of these types of cases, some in high-profile cases, and has obtained dismissals and "not guilty" verdicts

In 2006, Mr. Davis received an "Unsung Hero Award" from the Harris County Criminal Lawyers Association.  In that same year, he received the "Man of the Year Award" from the Houston Business and Professional Women's Association.  Also that same year, he made national news and was featured in several stories printed in the Houston Chronicle for his work that freed a man who had been wrongfully imprisoned for over 18 years for an alleged sexual assault of a child.  Although the government reported that there were no samples to test for DNA in the case, Mr. Davis pressed forward and found the DNA that freed his client.  This case was looked at as an example for reform by the Innocence Project and is featured on their web site.  After the client was pardoned, Mr. Davis secured financial compensation for him in excess of $450,000.00

In 2003, the Texas State Legisalture passed House Resolution 191 which commended Mr. Davis for his work as Special Counsel for the Texas State Commission on Judicial Conduct.  For the Commission, Mr. Davis was lead counsel in a case that removed a judge from office who was mistreating citizens by wrongfully jailing them and addressing them in an abusive manner in court.  Handling the case from beginning to end, Mr. Davis was able to obtain an order that the Judge never be allowed to hold judicial office again.

Davis & Associates has successfully defended many criminal cases.  But most notable is our office's successful defense of a double homicide in 2007 where the prosecutor boasted prior to trial that there was no way our client could win. With our client's approval, we rejected the prosecutor's 40 year plea deal, fought the case at trial, obtained a "not guilty" verdict and secured our client's freedom.  We have been able to secure "not guilty" verdicts and dismissals in other murder cases as well.  One client who had a Capital Murder case dismissed was recently featured in an article in the New York Times (article). 

Mr. Davis also has experience handling appeals and post conviction writs in both Federal and State Courts.  Our firm believes that Criminal Defense Lawyers should be knowledgeable of every aspect of a criminal case, trial and appeal, because the two go hand in hand.  In 2008, Mr. Davis, arguing before the United States Fifth Circuit Court of Appeals, obtained the reversal of a life sentence which was imposed by a Federal District Court in a drug conspiracy case.  Ms. Carpenter assisted Mr. Davis with the brief and preparation for the oral argument.

Jackie Carpenter has practiced law, as a licensed attorney, since 2003, but her love and interest in law developed at the age of 12.  Ms Carpenter pursued her passion for law through Teen Court, a program operated and supervised by Justice of the Peace Judge Anthony Polumbo in Baytown, Texas.  Additionally, Ms. Carpenter engaged her love of law in her adolescence when she competed as an attorney and a judge in the Texas Youth and Government Program, designed to teach legal proceedings to teenagers through mock trial competitions.  In the Texas Youth and Government Program, Ms. Carpenter served as the elected Chief Justice for the Texas Supreme Court.

Ms. Carpenter’s passion for the practice continued throughout college; she took a Business Law class that solidified her desire to seek a legal education after earning her Bachelor’s in Business Administration at The University of Texas at Austin.  Ms. Carpenter earned a Juris Doctorate degree at Thurgood Marshall School of Law, graduating at the top of her class, magna cum laude. 

Ms. Carpenter was able to realize her ultimate goal of practicing in 2003 after graduating from law school with honors and passing the Texas bar examination.  Since that time, Ms. Carpenter has worked various trials, individually and cooperatively with others, including, but not limited to: capital murder, murder, possession of controlled substances, felon in possession of a firearm, assault cases and others.  Ms. Carpenter’s recent successes include an aggravated sexual assault of a child case where a directed verdict of not guilty was entered at the close of the State’s evidence as well as a murder trial that resulted in a not guilty verdict from the jury. 

Outside of the courtroom, Ms. Carpenter excels in legal research and brief writing.  Ms. Carpenter also serves the community by making herself available to speak at seminars and/or other community or group events at no charge to discuss the constitutional rights of the accused.  Ms. Carpenter strongly advocates that everyone take time to learn about their constitutional rights before any police contact occurs.  Ms. Carpenter was recently arrested/detained by police officers investigating an aggravated robbery with a deadly weapon case.  This incident had a profound impact on Ms. Carpenter.  As a result of this traumatic experience; she better understands her clients.  Ms. Carpenter knows firsthand the pressures people face when confronted by police officers and the limited time in which an accused citizen has to make life-impacting decisions.

Ms. Carpenter and Mr. Davis work well together, each brings their own unique style and flare to the cases they work together.  They have worked with each other for close to seven years.  During that time, Ms. Carpenter assisted on the double homicide mentioned in Mr. Davis' profile above as well as argued a Batson motion during a murder trial that had the effect of changing policy at the Harris County District Attorney's Office and was featured on the front page of the Houston Chronicle and appeared on multiple television news programs.  Ms. Carpenter is a frequent guest blogger on the legal blog SUSTAINED!
